Please Support Vaccination By Choice Act HB0699

Your "FAVORABLE WITH AMENDMENT" (FWA) testimony supporting MD HB0699 as amended is requested. This legislation would prohibit requiring proof of Covid-19 vaccination at state public institutions of higher education.
 

Background:

A group of Maryland residents have been working hard to stop the University System of Maryland's Covid-19 vaccine mandate since April 23, 2021. When the current MD legislative session convened, they initiated outreach to many state legislators. That outreach resulted in collaborations to introduce legislation to end the USM Covid 19 vaccine mandates. They are now at the critical stage of seeking testifiers to support this bill.  
 
Information on Bill:
MD bill HB0699, State and Local Government - Proof of Vaccination for Employees and Applicants for Employment - Prohibition (Vaccination by Choice Act) has been published on the Maryland General Assembly site (see the bill text). With the amendment, this bill also prohibits proof of vaccination for state university students. If approved by the committee, the bill will be re-named “State and Local Government and Public Institutions of Higher Education – Proof of Vaccination – Prohibition (Vaccination by Choice Act)”
 

Information on the Testimony:

The testimony can be a maximum of 2 minutes, ideally it would be live (in-person in Annapolis, MD or virtual) to support this bill. Written testimonies are also requested and must be uploaded to the Assembly’s website. The hearing date for HB0699 with the proposed amendment is Monday, March 6, 2023, at 1 pm. Witness sign-up is Thursday, March 2nd from 8 am to 3 pm US EST ONLY. IMPORTANT UPDATE*Law firm investigating USM Mandate*Need to hear from students and staff

A prestigious law firm is investigating USM’s COVID-19 Vaccine Mandate.

If there are any current/former students or faculty/staff of the University System who fall into one of the below stated categories and are interested in discussing the mandate, please have them reach out.

For Faculty/Staff

1. Anyone who was fired or facing termination (or forced to seek other employment) because of the mandate.

2. Anyone who received an exemption but experienced ongoing harassment for remaining unvaccinated and put in a position where the "accommodation" provided was coercive to the point where its intent was to push the employee to receive the vaccine or leave their job.

3. Anyone who eceived the vaccine because of the mandate and suffered injury from the vaccine.

For Students

1. Anyone who had to leave their respective USM school, or had to transfer to another school, or even defer their enrollment due to the vaccine mandate.

2. Anyone removed from classes or who had to suspend their course of study because of the mandate. 

2. Anyone who sought to attend a USM school (ideally someone offered a scholarship to establish reliance interest) but had to go elsewhere due to the mandate.

3. Anyone who received the vaccine because of the mandate and suffered injury.

4. Anyone who received an exemption but has had unreasonable or onerous restrictions palced on them as part of their "accommodation" and continues to experience ongoing harassment due to their vaccination status.

**Examples: 

School forcing those with exemptions to live in isolation without roommates.

Unreasonably difficult Covid-19 testing requirements.

Professors/staff harassing or mistreating students based on their unvaccinated status (despite having an exemption).

NOTE- A bonus would be if the individual has documented natural immunity to Covid-19 and the school refused to acknowledge natural immunity as a substitute for vaccination.

USM Vaccine Mandate Litigation Update as of September 01, 2022:

 

CASE DISMISSED

 

On September 1, 2022, US District Judge, Richard D. Bennett, granted the Defendant’s

(USM) Motion to Dismiss and denied the Plaintiffs’ Motion for Preliminary Injunction. The

Court found that the plaintiffs could not “prove the likelihood of success on the merits of

their case.” The Court noted merit in the Defendant’s arguments, which were as follows:

1. The Plaintiffs lacked standing due to receiving religious exemptions.

2. The Defendants are “shielded by [state] sovereign immunity”.

3. The precedent that courts have previously “upheld vaccine mandates”.

Dear petition supporters,

Unfortunately, Covid-19 vaccine mandates are still alive and well at University of MD institutions. The lawsuit to stop the mandates is currently in limbo on the judge's desk and our attempts to get answers have been ignored.

The Board of Regents will be meeting on April 29, 2022. They do not have any intention to discuss their Covid-19 mandates and policies. This means that they will not accept public comment on the topic.

Booster mandates announced for USM employees and students

On January 7, 2022, the USM mandated the booster shots for employees and students who live on campus. Salisbury and College Park campuses have extended this mandate to commuter/off campus and study abroad students as well. Many are concerned that booster shots are not justified or safe, especially in 18-24 year olds, and would like to decline without punitive consequences.
