I nderuar zotëri,

1. Duke pasur parasysh se është detyrë e njerëzve që t'i respektojnë kafshët dhe të garantojnë përfitimin e tyre nga legjislacioni që i mbron në mënyrë të mjaftueshme dhe të efektshme;

2. Duke pasur parasysh se kjo detyrë po njihet dhe po vlerësohet gjithmonë e më shumë jo vetëm në shoqërinë shqiptare, por edhe në mbarë botën, dhe se i ka bërë qeveritë, parlamentet dhe bashkitë e rajoneve të ndryshme të botës të ndërmarrin hapa legjislativë dhe praktikë përpara për mbrojtjen e kafshëve;

3. Duke pasur parasysh se, pavarësisht se kjo e fundit është edhe detyrë e shtetit shqiptar, ky shtet nuk i është përgjigjur kësaj detyre dhe nuk i ka përmbushur përgjegjësitë e tij në këtë fushë, duke i lënë kështu kafshët në Shqipëri të braktisura mizorisht dhe viktima të indiferencës shtetërore, duke lejuar kështu, nëpërmjet veprimeve dhe mosveprimeve të tij, shkaktimin e shumë dëmeve serioze ndaj kafshëve në një ambient pa asnjë lloj ndëshkimi ;

4. Duke pasur parasysh se duke mos marrë masa legjislative proaktive, moderne dhe mjaftueshmërisht të efektshme; duke mos ndaluar praktikat mizore, të papranueshme dhe absolutisht të panevojshme, si dhe duke përshirë disa institucione, midis të cilave edhe bashkitë, në trajtimin mizor të kafshëve, shteti shqiptar shpërfill të gjitha Aktet Evropiane për Mbrojtjen e Kafshëve;

5. Duke pasur parasysh se shteti shqiptar dëshiron të promovojë turizmin duke rritur ndjeshmërinë dhe humanizmin e shtetasve të tij, këtij shteti i kërkohet t'i mbrojë kafshët e tij e të japë shembuj humanizmi e respekti;

Ne, nënshkruesit e këtij peticioni, i bëjmë thirrje parlamentit shqiptar të hartojë dhe të miratojë një Ligj për Mbrojtjen e Kafshëve, i cili duhet të jetë:

a) me një gamë të gjerë zbatimi në mënyrë që të përcaktojë rregulla për mbrojtjen e kafshëve në shumë fusha ku kafshët, në një mënyrë apo tjetër, përdoren dhe përfshihen,

b) koherent, i qartë dhe specifik në mënyrë që dispozitat e tij të kuptohen, të respektohen dhe të zbatohen,

c) shumë mbrojtës, duke parashikuar:

i) çdo ndalim të përkufizuar në të, pa asnjë ekuivok

ii) gjoba të forta për shkelje të ligjit, dhe

iii) leje ekskluzive ligjore për mbajtjen e kafshëve në robëri dhe/ose për t'u shkaktuar atyre dhimbje, vuajtje dhe/apo vdekje vetëm në rastet kur kjo është patjetër e nevojshme apo e justifikueshme, si dhe duke parashikuar në mënyrë të qartë dhe strikte mënyrën e dhënies së këtyre lejeve,

d) i lehtë për t'u zbatuar në mënyrë që organet dhe zyrtarët e ngarkuar me zbatimin dhe respektimin e ligjit të mund ta kryejnë punën e tyre zbatuese sa më drejtpërdrejt, shpejt dhe me efektshmëri, në mënyrë që shkeljet të mund të ndëshkohen sa më shpejt dhe në mënyrën më efiçente të mundshme, si dhe të shoqërohen me masa të menjëhershme parandaluese për mbrojtjen e sigurisë dhe integritetit të kafshëve të cenuara - masa, të cilat duhet të vihen menjëherë në zbatim pikërisht nga këto organe dhe këta zyrtarë.

To His Excellency the Prime Minister of Albania:

Dear Sir,

1. Considering that it is the duty of humans to respect animals and to ensure that these benefit from legislation which protects them in an adequate and effective way;

2. Considering that this duty is increasingly recognized and valued not only within the Albanian society but also across the world, and that it has been driving governments, parliaments and municipalities from several regions of the world to take advanced legislative and practical steps to protect animals;

3. Considering that, in spite of the latter being also a duty of the Albanian State, this state has not been matching it, or meeting its responsibilities in this field thus leaving Albanian's animals cruelly abandoned and victims of the state indifference, which, both by actions and omissions, has been permitting that many and serious harms committed against animals may happen in an environment of total impunity;

4. Considering that the Albanian State, by not taking proactive, modern, effective and adequate legislative measures, by not forbidding cruel, unacceptable and absolutely unnecessary practices, and also by involving some of its institutions, among which are the municipalities, in the cruel treatment of animals, disregards all European Animal Protection Acts;

5. Considering that the Albanian State wants to promote tourism by enhancing the sensitivity and humanity of its citizens, this state is called to protect its animals and give example of humanity and respect;

We, the undersigned, call on the Albanian Parliament to establish and enact an Animal Protection Law that is

a) wide-ranging, in a way that it establishes animal protection regulations affecting all areas in which animals are somehow used and involved,

b) coherent, clear and specific, in a way that its provisions can be understood, respected and enforced,

c) strongly protective, establishing:

i) unequivocally the prohibitions which are due to be defined,

ii) strong penalties to the infringements of the law, and

iii) exclusive legal permissions to hold animals in captivity and/or to inflict pain, suffering and/or death to animals only in the cases in which that is strictly necessary and justified, also rigidly and clearly regulating those permissions,

d) easy to enforce, in a way that the agencies and officials which are responsible for enforcing the law and making sure it is respected may execute their enforcement work in the most direct, fast and effective manner, so that the infringements may be punished as swiftly and efficiently as possible, also to be accompanied of immediate and precautionary measures to protect the affected animals´ safety and integrity - measures which should be also immediately put to practice by these very agencies and officials.

Его Превосходительству Премьер-Министру Республики Албания:

Уважаемый господин ...

1) Принимая во внимание то, что люди должны уважать права животных, которые должны быть закреплены законодательными актами;

2) Принимая во внимание то, что эта проблема привлекает все больше внимания и признания не только в албанском обществе,

но и по всему миру, что побудило правительства, парламенты и муниципалитеты других стран и регионов утвердить усовершенствованные

законодательные акты и принимать практические меры по защите животных;

3) Принимая во внимание то, что эта проблема - это также и забота Албанского государства, но в этой области оно не удовлетворяло своей

ответственности в полной мере, в результате чего албанские животные были жестоко брошены и стали жертвами безразличия,

в результате чего нанесенный ущерб здоровью животных или окружающей среде оставался безнаказанным;

4) Учитывая то, что Албанское государство, не принимая активных законодательных мер, своевременных и эффективных,

не останавливая жестокой практики, неприемлемой и не нужной, а также привлекая некоторые институты, такие как муниципалитеты, против жестокого

обращения с животными, противоречит всем Европейским актам о защите животных;

5) Учитывая, что албанское государство хочет способствовать развитию туризма путем повышения чувствительности и человечности своих граждан,

этой стране необходимо защищать своих животных и показывать пример человечности и уважения;

Мы, нижеподписавшиеся, призываем парламент Албании установить и ввести в действие закон о защите животных, который

а) в широком диапазоне, таким образом, что он устанавливает правила защиты животных, затрагивающих все области,

в которых животные каким-то образом задействованы и принимают участие,

б) последовательный, четкий и конкретный, таким образом, что его положения могут быть понятыми, уважаемыми и соблюдаемыми,

с) настоятельно защающий животных, устанавливающий:

I) однозначные запреты, которые должны быть определены,

II) строгие меры наказания к нарушениям закона, и

III) эксклюзивные юридические разрешения содержать животных в неволе и/или причинять боль, страдания и/или смерти животных

только в тех случаях, когда это строго необходимо и оправдано, а также жестко и четко регулирующие эти разрешения,

г) легко осуществить, таким образом, что органы и должностные лица, которые отвечают за правоохранительную деятельность могут исполнить

свою работу в самым прямым, быстрым и эффективным способом, так что нарушения могут быть наказаны так быстро и эффективно, насколько

это возможно, чтобы также соблюдались меры предосторожности для защиты пострадавших животных, меры их безопасности и неприкосновенности

- меры, которые должны быть также немедленно выполняться на практике именно этими учреждениями и должностными лицами.
