CLC Petition

TO WHOM IT MAY CONCERN

We are writing this letter to bring to your attention something that we (Commercial Law students 2021) believe is unfair and requires your attention. We would like the Commercial law (CLC101T) exam to be reviewed under the following concerns noted in the paper:

  • Question 1 of the exam required students to list clauses of a construction standard (JBCC) and mention where they are applicable. It is unfair for students to memorize industry standard especially the one which is outdated for the purpose of learning wand furthermore, it is a general rule that we refer to the standards in industry and its application.
  • Question 2 asked about a close corporation (CC) which it was declared that people will no longer be able to open this type of structure. The application/relevance of this question is questionable since majority of our learning units fall under Law of Contract which did not form part of the exam.
  • Out of 12 learning units, the lecture chose to ask 2 chapters (CC and Insolvency which is relevant) as an overall assessment of the course. We believe it is not a representation of the overall course and its very skewed.

We ask that in light of this information/grievance, the department intervene and assist the students in this matter. The parties to this petition are listed in the below table with contacts details:
