PETITION FOR NEW LAW FOR PERSONAL ASSISTANCE, GUARANTEEING ACTIVE AND INDEPENDENT LIFE TO DISABLED PEOPLE

Politicians and Government of Republic of Bulgaria,

The Republic of Bulgaria ratified the UN Convention for disabled people’s rights (The Convention) on 26th January 2012. Fulfilling our country's commitments to implement the provisions of the Convention, an experts’ working group in the Ministry of Labour and Social Policy was formed, which has prepared an Action Plan of The Republic of Bulgaria for the Convention’s application for disabled people (2015-2020).

The Council of Ministry for The Republic of Bulgaria adopted an Action plan by decision No. 467 on 25 June 2015 for applying of the UN Convention for Disabled People’s rights (2015 – 2020).

The Republic of Bulgaria has undertaken the chairmanship of the Council of the European Union on 1st January 2018 and the responsibility for the general decisions of the Council of EU in all aspects of its proceedings.

The Chairmanship will focus on four basic fields: Europe’s future, young people, Western Balkans, security and stability and digital economics.

We are appealing as equal citizens of Europe and the world for the following:

1. A Vote on a law for personal assistance for all people with disabilities – children and adults, which is consistent with the principles and values enshrined in the UN Convention, on the Rights of Persons with Disabilities and the European Convention on Human Rights, as persons with a corresponding degree of disability to be entitled to a personal assistant depending on the degree of disability, enabling people with intellectual and emotional status to be able to practice both teaching activity, as well as they can do their job. A personal assistant or social assistance gives the prospect of a decent life, satisfying the life needs of a person, including food, communal needs, transport, better health etc., ensuring the rights and ability of every person with physical dependence to choose, hire, manage and release the people who serve him, compensating for the deficit caused by their disability, no matter where she/he lives.

2. To ensure an accessible mechanism for individual assessment of people with disabilities to reach all public services, for technical means of transport. Update the list of aids in accordance with European and world standards.

3. An Adoption of a new mechanism for individual assessment of disabilities, provision of technical and auxiliary means of transport. Update the list of aids in accordance with European and world standards

4. The making of administrative liaison between the labour offices of the municipalities and the social services bureau, for the provision of jobs to the unemployed, such as personal assistants, carers and accompanying persons with disabilities. In this respect, a computerized database for jobseekers and job vacancies for personal assistants should be prepared, both on a regional scale - both municipal and national.

5.To establish training, qualification and certification programs for personnel specializing in the care, movement and implementation of adequate, emergency response actions before medical and paramedical teams arrive.
