A Petition for bail revocation & the detention of Wellington Vusimuzi Ndlovu
We, the undersigned residents of Kinross and concerned citizens, hereby petition the court to immediately revoke the bail granted to Vusimuzi Willington Ndlovu accused of the repeated sexual abuse and physical assault of a minor child, Omphile Dlamini, aged 10.We further demand his immediate detention pending sentencing.
Background:
Omphile, now 10 years old, has been subjected to prolonged and severe sexual abuse by her stepfather, Vusimuzi Willington Ndlovu, since the age of 5. Medical examinations, initiated by concerned school personnel, have confirmed that the child has been penetrated, substantiating the allegations of sexual assault.
A case was opened with the South African Police Service (SAPS). Vusimuzi Wellington Ndlovu applied for bail, and was granted bail on the 19 March 2025, with specific conditions, including a strict prohibition from being present in Kinross, where the victim resides, as he is not a resident of Kinross. It has also been revealed that the accused subjected the child to physical abuse and, on occasion, sexual assault in the presence of the child's mother, who was often intoxicated.
The child's mother is currently supporting the accused, claiming that her daughter is fabricating the abuse.
Grounds for Petition:
Within two days of being granted bail, Vusimuzi Wellington Ndlovu was seen in Kinross, frequenting local taverns, in direct violation of the court's explicit order. This demonstrates a blatant disregard for the judicial process and the safety of the victim. The accused is charged with heinous crimes, including repeated sexual abuse and physical assault of a vulnerable minor. The severity of these offenses warrants his immediate detention to protect the victim and ensure the integrity of the judicial process.
The continued presence of Vusimuzi Willington Ndlovu in the community poses a significant risk to Omphile’ s safety and well-being. The victim requires a safe and secure environment, free from the threat of further harm. The community of Kinross is deeply disturbed by the accused's actions and the perceived leniency of the bail conditions. We fear that his continued presence in the area will undermine public trust in the justice system and create a climate of fear.
The mother of the child is actively supporting the accused, which poses a risk for witness intimidation. The presence of the accused in the the community only exacerbates this risk.
Demands:
We demand that the court immediately revoke the bail granted to Vusimuzi Willington Ndlovu.
We demand that Vusimuzi Willington be detained in custody pending his sentencing.
We urge the National Prosecuting Authority to pursue this case with the utmost diligence and ensure that justice is served for Omphile.
We demand that the SAPS strictly enforce the prohibition of the accused from the Kinross area.
We ask that the court consider the emotional and psychological trauma inflicted on the child when determining sentencing.
We request that the court and relevant social services provide the child with all required emotional and psychological support. We believe that the safety and well-being of a child should be paramount.
We, the undersigned, call upon the court to take immediate action to protect Omphile and uphold the principles of justice. And we hereby support this petition for the bail revocation and the immediate detention of Mr. Wellington V. Ndlovu.
