Subject           :           Request to Expedite and Open  the Amenities / Facilities                                        of Suntrust Asmara Pending Since Dec. 2017  

Sir,              

                   This is with reference to the above subject matter regarding the unfinished Amenities still Under Construction. May we know the specific target completion date to finish the construction of the following: (Lap Pool, Kiddie Pool, Pool Lounge, Paved pool Deck, Play Area, Zen Garden and Outdoor Lounge, Gazebo-type Multi Purpose Area, Day care Center, Jogging Path and Function Rooms).              

                   Informatively, the residents  are being required to pay the Full Amount of the Assoc Dues as per Board Resolution -001 released on December 7, 2019. In the Marketing Campaign brochures (see attached brochure), the above cited facilities which are supposed to be completed as stated Completion Date: December 2017.(Annex A-1 and A-2) The unitowners are religiously paying the Assoc Dues and some are even making Advance Payments for One Full Year  which we find very unfair  to be paying without enjoying the benefits of these amenities that we paid for.  In accordance with PD 957 to wit:    

Presidential Decree No. 957 Section 19   Advertisements – Advertisements that may be made by the owner or developer through newspaper, radio, television, leaflets, circulars or any other form about the subdivision or condominium or its operations or activities  must reflect The real facts and must be presented in such manner that will not tend to mislead or Deceive the public.   The owner or developer shall answerable and liable for the facilities, Improvements, infrastructures or other forms of development represented Promised in brochures, advertisements and other sales propaganda disseminated by the owner or developer or his agents and the same shall form part of the sales warranties enforceable against said owner or developer, jointly and severally. Failure to comply with these warranties shall also be punishable in accordance with The penalties provided for in this Decree. Section 20. Time of Completion   Every owner or developer shall construct and provide the facilities, Improvements, infrastructures and other forms of development, Including water supply and lighting facilities, which are offered and indicated in the approved subdivision or condominium plans, brochures, prospectus, printed matters, letters or in any form of advertisement, within one year from the date of issuance of the license for the subdivision or condominium project or such other period of time as may be fixed by the Authority.                

          In the interest of justice and fairness therefore, can your good office provide us an estimated date to complete the said facilities, even if the construction of each facility cannot be simultaneously  because people are forced to stay at home without recreation. May we request for the opening of all Sky Gardens at Tower 1 while observing restrictions currently imposed by the government.                

          May we humbly request that your response be in WRITING so that we can reproduce and circulate for the information of all existing residents of Tower 1 and incoming Towers 2 and 3 unitowners. Moreover, the said response be coursed through Ms. Mary Jane Artuz Property Administrator and attention to all Suntrust Asmara Unitowners.
