The legislation as proposed currently is not well written, has not been subject to all of the proper process, does not meet requirements for accession to international treaties and fails to address practical aspects needed for implementation across the wider creative and other IP-rich industries. Also the legislation, as proposed, will put local South African artists, creators and innovators at a disadvantage when compared to their counterparts in other countries. It presents serious disincentive to foreign direct investment (FDI) which will disappoint South Africa’s current objectives.
