Declaration of Texas Border with Mexico as an Invasion

Though securing the border is the federal government's responsibility, the Constitution empowers state governments to act when our federal government refuses.   Article I, Section 10, Clause 3 of the U.S. Constitution states, "No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay." 

  • The state of Texas in accordance with the failure of the federal government to provide the necessary defense and safety of the legal residents of the state shall envoke the constitutional requirement to declaring the border with Mexico as an invasion. 
  • Sufficient evidence has been seen and experienced by Texas, as to call upon the governor to immediately declare an invasion and close the border within ninety days.
  • The invasion shall include reparations to the counties, cities, towns, ranches, and commercial enterprises. The Rio Grande river shall be restored and improved as necessary to provide proper water management
