JPBFOA:Protest Association decision on signing MoU and invalidating EGB (24-12-2023)

Mr Elangovan Secretary of JPBFOA,
I am a member of the JPBFOA. I am very much distressed to see the developments in our Association in the recent past. I strongly protest the following actions of the Association and I am not in favour of subscribing my consent to the following undemocratic activities of the association.
1. When the facility of online poll is available, and several decisions were taken earlier by way of online poll, you have resorted to pass a resolution without getting opinion or views from all the members for extension of the term of the association office bearers for 6 months. You have passed the resolution after giving only 7 days notice. Further there is no provision in our bye laws as well as in TN Apartment Iwnership Act 1994 to extend the term of office bearers as you have done.
2. You have arranged Emergency General Body after giving 7 days notice and passed resolution with the support of few members for signing an MOU with the Jain Housing and Phase 2 without circulating the contents to the members thereby the interest of phase 1 owners were not protected. You have also ignored various mail notices forwarded by our members in this connection. You have taken decisions to favour Jain Housing and Phase 2 owners.
3. I strongly feel that the issues relating merger of land have 1&2, sharing of club house etc are very important one as this has to be well thought through by all members and there is no need to get it resolved in an EGB and should have tabled or discussed only in a regular GB and that too the Association being in an extended term purely for completing accounting and auditing purpose has no authority to pass such resolutions.
Therefore if required I am in favour of taking any kind of legal action against the JPBFOA to protect my rights in my property.
