The Bill will not achieve its objective of ensuring the protection of rights-holders in the digital environment, and does not address the pertinent problem of the value gap. In fact it creates leeway for opportunistic global tech companies to use the works of South African rights-holders without the need to compensate them through the expansive fair use provisions without having conducted a proper impact assessment for local rights-holders. The EU has gone ahead to introduce amendments to the EU Copyright Directive that are more considerate of the rights of authors than what our legislators, who have to deal with developing nation artist, have done with the current Copyright Amendment Bill.
